3. Subject of Performance

The subject of transactions through the online payment gateway is the acceptance of one-time and recurring monetary donations from the public, intended to support the charitable and endowment activities of the Operator.
The Donor acknowledges that financial contributions are provided voluntarily and without any entitlement to consideration.

4. Prices and Payment Terms

  1. The amount of the donation is chosen by the Donor individually within the payment gateway.

  2. Payments are accepted via a secure online payment gateway.

  3. Funds are credited directly to the bank account of the Prague Peak Endowment Fund held at [to be specified bank].

5. Rights and Obligations of the Parties

  • The Operator undertakes to use the received funds exclusively in accordance with the mission and statutes of the Endowment Fund.

  • The Donor acknowledges that by making a donation, no legal claim arises to a specific use of their funds or to the provision of goods or services.

6. Complaints and Refunds

  1. In the event of an erroneous or unauthorized payment, the Donor may contact the Operator using the contact details provided above.

  2. The Donor has the right to request a refund of the donation only in the case of a demonstrable error in the transaction.

  3. In all other cases, donations are non-refundable.

7. Protection of Personal Data

The Operator processes personal data of Donors in accordance with applicable legislation (in particular GDPR). 

8. Final Provisions

1. Úvodní ustanovení

Tyto Všeobecné obchodní podmínky (dále jen "VOP") upravují práva a povinnosti mezi Nadačním fondem Prague Peak, IČO: 485 489 87, se sídlem Zborovská 58 Praha 5 150 00, zapsaným u Městského soudu v Praze v oddílu N, vložce číslo 235 , (dále jen "Provozovatel"), a dárci (dále jen "Zákazník" nebo "Dárce") při poskytování peněžních darů prostřednictvím online platební brány dostupné na webových stránkách [doplnit URL].

3. Předmět plnění

Předmětem prostřednictvím online platební brány je přijímání jednorázových i opakovaných peněžních darů od veřejnosti, určených k financování charitativních a nadačních aktivit Provozovatele.
Dárce potvrzuje, že poskytuje finanční prostředky dobrovolně a bez nároku na protiplnění.

4. Ceny a platební podmínky

  1. Výše daru si volí Dárce individuálně v rámci platební brány.

  2. Platby jsou přijímány prostřednictvím zabezpečené online platební brány.

  3. Peněžní prostředky jsou připsány přímo na účet Nadačního fondu Prague Peak vedený u [doplnit banku].

5. Práva a povinnosti smluvních stran

  • Provozovatel se zavazuje použít přijaté finanční prostředky výhradně v souladu s posláním a stanovami nadačního fondu.

  • Dárce bere na vědomí, že poskytnutím daru nevzniká žádný právní nárok na konkrétní užití jeho finančních prostředků ani na poskytnutí služby či zboží.

6. Reklamace a stornování plateb

  1. V případě chybné nebo neautorizované platby je možné se obrátit na Provozovatele prostřednictvím výše uvedených kontaktních údajů.

  2. Dárce má právo požádat o vrácení daru pouze v případě prokazatelné chyby při transakci.

  3. V ostatních případech není dar vratný.

7. Ochrana osobních údajů

Provozovatel nakládá s osobními údaji dárců v souladu s platnými právními předpisy (zejména GDPR). 

8. Závěrečná ustanovení

  1. Tyto VOP nabývají účinnosti dnem [doplnit].

  2. Provozovatel je oprávněn VOP jednostranně měnit či doplňovat. Aktuální znění je vždy zveřejněno na webu.
