1. Introductory Provisions

These General Terms and Conditions (hereinafter referred to as the "Terms") govern the rights and obligations between the Prague Peak Education Fund , ID No.: 485 489 87, with its registered office at Zborovská 58, 150 00 Prague 5, registered with the Municipal Court in Prague, Section N, Insert No. 235 (hereinafter referred to as the "Operator"), and donors (hereinafter referred to as the "Donor") when providing monetary donations pursuant to Section 2055 et seq. of Act No. 89/2012 Coll., the Civil Code (hereinafter referred to as the "Civil Code"), through the online payment gateway available at www.ppef.cz

3. Subject of Performance

A payment made through the online payment gateway constitutes exclusively a one-time or recurring monetary donation by the Donor, intended to finance the charitable and endowment activities of the Operator.

By making the payment, the Donor confirms that the financial means are provided as a donation voluntarily, without any entitlement to consideration and without an order under Section 2064 of the Civil Code, and the Operator accepts the donation as made.

4. Payment Terms

The amount of the donation is chosen individually by the Donor within the payment gateway.

Payments are accepted through a secure online payment gateway.

Funds are credited directly to the bank account of the Prague Peak Education Fund Endowment maintained with Fio Bank.

5. Rights and Obligations of the Parties

The Operator undertakes to use the received financial means exclusively in accordance with the mission and statutes of the Endowment.

The Donor acknowledges that by making a donation, no legal claim arises to a specific use of the donated funds or to the provision of goods or services.

6. Complaints and Cancellations of Payments

In the event of an erroneous or unauthorized payment, the Donor may contact the Operator using the contact details provided above.

The Donor has the right to request the return of a donation only in the case of a demonstrable error in the transaction.

In all other cases, the donation is non-refundable, except as provided under the Civil Code regarding the revocation of a donation for need or ingratitude.

7. Protection of Personal Data and Consumer Information

The Operator processes personal data of Donors, if shared in connection with the donation, in accordance with applicable legislation (in particular GDPR).

If the Donor acts in relation to the Operator as a consumer, the Donor is entitled, in the case of a donation agreement concluded remotely, to withdraw from such agreement within 14 days from the date of its conclusion. The body competent for out-of-court dispute resolution between the Donor and the Operator in such case is the Czech Trade Inspection Authority (Česká obchodní inspekce): www.coi.cz

8. Final Provisions

These Terms come into effect on 2 October 2025.

The Operator is entitled to unilaterally amend or supplement the Terms. The current version is always published on the website.

These Terms are governed by the laws of the Czech Republic, and disputes arising therefrom shall be decided by the courts of the Czech Republic according to the registered office of the Operator.

1. Úvodní ustanovení

Tyto Všeobecné obchodní podmínky (dále jen "VOP") upravují práva a povinnosti mezi Nadačním fondem Prague Peak Education Fund, IČO: 485 489 87, se sídlem Zborovská 58 Praha 5 150 00, zapsaným u Městského soudu v Praze v oddílu N, vložce číslo 235 , (dále jen "Provozovatel"), a dárci (dále "Dárce") při poskytování peněžních darů podle ustanovení § 2055 a násl zákona č. 89/2012 Sb. (dále jen "občanský zákoník) prostřednictvím online platební brány dostupné na webových stránkách www.ppef.cz.

3. Předmět plnění

Platba učiněná prostřednictvím online platební brány představuje výlučně jednorázový či opakovaný peněžní dar Dárce, určený k financování charitativních a nadačních aktivit Provozovatele.

Dárce učiněním platby potvrzuje, že poskytuje finanční prostředky darem dobrovolně, bez nároku na protiplnění a bez příkazu podle § 2064 občanského zákoníku a Provozovatel takto učiněný dar přijímá.

4. Platební podmínky

Výši daru si volí Dárce individuálně v rámci platební brány.

Platby jsou přijímány prostřednictvím zabezpečené online platební brány.

Peněžní prostředky jsou připsány přímo na účet Nadačního fondu Prague Peak vedený u Fio Banky.

5. Práva a povinnosti smluvních stran

Provozovatel se zavazuje použít přijaté finanční prostředky výhradně v souladu s posláním a stanovami nadačního fondu.

Dárce bere na vědomí, že poskytnutím daru nevzniká žádný právní nárok na konkrétní užití jeho finančních prostředků ani na poskytnutí služby či zboží.

6. Reklamace a stornování plateb

V případě chybné nebo neautorizované platby je možné se obrátit na Provozovatele prostřednictvím výše uvedených kontaktních údajů.

Dárce má právo požádat o vrácení daru pouze v případě prokazatelné chyby při transakci.

V ostatních případech není dar vratný s výjimkou ujednání občanského zákoníku o odvolání daru pro nouzi nebo nevděk.

7. Ochrana osobních údajů a poučení pro spotřebitele

Provozovatel nakládá s osobními údaji Dárců, pokud jsou v rámci darování s Provozovatelem sdíleny, v souladu s platnými právními předpisy (zejména GDPR). Pokud Dárce ve vztahu k Provozovateli vystupuje jako spotřebitel, svědčí mu v případě uzavření darovací smlouvy distančním způsobem právo od takové smlouvy odstoupit do 14 dnů ode dne uzavření smlouvy; subjektem mimosoudního řešení sporů mezi Dárcem a Provozovatelem je v takovém případě Česká obchodní inspekce: www.coi.cz.

8. Závěrečná ustanovení

Tyto VOP nabývají účinnosti dnem 2.10.2025.

Provozovatel je oprávněn VOP jednostranně měnit či doplňovat. Aktuální znění je vždy zveřejněno na webu.

Tyto podmínky se řídí právním řádem České republiky a o sporech z nich vzniklých rozhodují soudy České republiky dle zapsaného sídla Provozovatele .
